These Terms of Service form an integral part of the distance contract concluded between the parties when the Customer places an order on the online wine store www.dagamawines.com. By placing an order, the Customer confirms they are at least 18 years old, acknowledges these Terms, and agrees to comply with them. If the Customer does not accept these Terms, they may not make purchases on www.dagamawines.com.
1. Definitions
- Seller: The online wine store at www.dagamawines.com, owned and operated by SIA Flow House Latvia, registration no. 40103953644 (Speciālā atļaujā (Licence) alkoholisko dzērienu mazumtirdzniecībai: MT Nr. 00000014303), with a registered address at Torņa iela 4, Rīga, LV-1050.
- Customer: A natural person at least 18 years of age, legally able to enter into contracts with the Seller, who purchases goods from the online store.
2. Ordering
2.1. When placing an order, the Customer must provide the recipient’s full name, email, phone number, and delivery address.
2.2. Orders are accepted 24/7, and order-related notifications will be sent for fulfillment and tracking purposes, regardless of opt-out preferences.
2.3. Orders may be canceled within 24 hours if they have not yet been dispatched. Contact Customer Service with the order number to request cancellation.
3. Prices, Payments, and Delivery Costs
3.1. All prices are listed in EUR (€) and include VAT and any applicable taxes.
3.2. Prices at checkout are final for that transaction, though prices may change on the website at any time.
3.3. Accepted payment methods include major credit and debit cards and other secure options at checkout. Payment details are processed securely, with no storage of sensitive information.
3.4. Delivery costs are calculated at checkout based on location and package size/weight. Orders over a certain value may qualify for free shipping, as stated on the website.
4. Product Collection and Delivery
4.1. Delivery is typically within 3-7 business days of dispatch, although times may vary due to customs or other unforeseen delays.
4.2. Orders will be delivered to the address provided at checkout, and an adult (18+) must be available to accept delivery. Inaccurate addresses may result in redelivery fees.
4.3. If delivery cannot be completed due to the absence of an eligible recipient, alternative arrangements must be made directly with the courier.
5. Product Quality Assurance and Responsibility
5.1. Product images and descriptions are as accurate as possible, though variations in color, packaging, or vintage may occur.
5.2. The Seller assumes no liability for minor differences in product presentation due to technical constraints or manufacturer updates.
6. Right of Withdrawal, Returns, and Refunds
6.1. Customers may exercise a right of withdrawal within 14 days of delivery, notifying the Seller and returning items unopened and undamaged, at the Customer's expense.
6.2. Damaged or faulty products must be reported within 7 days with a photo attached. Replacements or refunds will be provided upon verification. Refunds are issued to the original payment method within 7-10 days of product return.
6.3. Due to the nature of our products, returns are accepted only for faulty items or authorized returns. Returned items must be unopened and in original packaging.
7. Privacy and Data Protection
7.1. Customer data is collected and processed for order fulfillment, customer support, and service improvement in compliance with Latvian data protection laws.
7.2. Personal data is retained only as needed for contract fulfillment and legal obligations, with strict security measures in place to prevent unauthorized access.
8. Liability Limitations and Force Majeure
8.1. The Seller's liability is limited to the total amount paid by the Customer for the order, and the Seller is not responsible for indirect or incidental damages resulting from the use of this website or products purchased.
8.2. The Seller is not responsible for delays or failure to fulfill obligations due to circumstances beyond its control, such as natural disasters, strikes, or transport disruptions. The Seller will notify the Customer if such events impact order fulfillment.
9. Intellectual Property
9.1. All content on www.dagamawines.com, including images, text, and logos, is the property of SIA Flow House Latvia and protected by copyright and intellectual property laws. Unauthorized use of this content is strictly prohibited.
10. Governing Law and Dispute Resolution
10.1. These Terms are governed by the laws of the Republic of Latvia, and any disputes will be resolved in Latvian courts. Parties are encouraged to seek amicable resolutions before pursuing legal action.
11. Changes to Terms and Conditions
11.1. The Seller reserves the right to modify these Terms at any time. Changes take effect immediately upon posting on www.dagamawines.com. Continued use of the website indicates acceptance of the updated Terms.
